DISTRIBUTORS, CUSTOMERS AND THIRD PARTIES

PRIVACY NOTICE

 

In compliance with the provisions of the Mexican Federal Law for the Protection of Personal Data in possession of individuals published in the Mexican Official Gazette of the Federation on July 5, 2010 (the Law), this Privacy Notice is extended.

 

  1. Responsible for the processing of personal data:

 

For the purposes of this Privacy Notice, DINAMICA Y SANEAMIENTO DE CAUDALES, S.A. DE C.V. and its affiliated and subsidiary companies, indicate as responsible for the collection, disclosure, storage, use, handling, use, transfer or disposal of personal data (hereinafter the “Treatment”) to DINAMICA Y SANEAMIENTO DE CAUDALES, S.A. DE C.V. (hereinafter “DYSAC”) with address at 27, Vidriera de los Reyes, 1st Floor, Colonia Vista Hermosa, Tlalnepantla, State of Mexico, C.P. 54080, for which we inform you that the personal data you provide us as a distributor, customer or potential customer, will be treated strictly for the purposes indicated below.

 

  1. Information to be collected:

 

The personal data that will be processed by DYSAC, consists of personal information of the Holder, which may include: your name, denomination or company name, Articles of Incorporation, Commercial References, Tax Address, Private Address, RFC (Taxpayer Registration Number) or CURP, Official Identification of the person signing the request, Proof of Address, Telephone Number, Email, as well as financial or patrimonial data (Annual Statement of two (2) previous years, Financial Statements of two (2) previous years and one (1) with no more than three (3) months issued), among others strictly indispensable for the purposes that will be indicated below.

 

In case of not having your personal data, DYSAC would not be able to register you as a distributor, customer or potential customer; to comply with the obligations arising from the possible legal relationship between you and DYSAC; to comply with the applicable legislation; to prepare possible orders, service requests, commercial evaluations, quotations and any pre-contractual activity; therefore, DYSAC would not have any type of responsibility derived therefrom.

 

III. Purposes of information processing:

 

DYSAC collects your personal data without the purpose of disclosure or commercial use thereof, and will be processed only for the following purposes:

 

In the case of Distributors:

 

  • Providing you with a good and/or service.
  • Development and execution of contracts with the distributor that may be required.
  • Fulfillment of obligations arising from the legal relationship established with the distributor.
  • Follow up the commercial relationship.
  • Answering inquiries.
  • Statistical and market analysis.

 

In the case of Clients:

 

  • Provide you with a good and/or service.
  • Statistical and market analysis.
  • Follow up the commercial relationship.
  • Respond to your inquiries.
  • Marketing and advertising.

 

In the case of Potential Customers:

 

  • Carry out marketing and promotional activities in general.
  • Offer our products and/or services.
  • Statistical and market analysis.
  • Respond to your inquiries.

 

By virtue of the above, from the moment you give us your consent DYSAC may keep in its records, both physical and electronic, all the information that has been provided to us by you through any of the means made available by DYSAC in order to collect your Personal Data.

 

Your personal data will be kept under the strictest confidentiality and will not be used for any purpose other than those mentioned above, unless there is a change in this Privacy Notice.

 

It is important to let you know that DYSAC will at all times refrain from selling or renting your Personal Data to any third party.

 

Once the purpose of the processing of personal data has been fulfilled, such data will be blocked for the sole purpose of determining possible liabilities in relation to its processing, until the legal or contractual statute of limitations period. During such period, the personal data may not be processed and after such period, they will be deleted from the corresponding database.

 

  1. Information that is automatically collected on the Web site:

 

To improve the visitor’s experience on our site, our Web page uses technology called “cookies”.

“Web beacons or transparent .gifts are small pieces of code implemented on a web page to monitor visitor behavior, as well as gather information from the visitor viewing the web page. For example, web beacons can be used to count the number of users visiting the web page or send a cookie to the browser of the visitor who is using the page. We may use web beacons on the site, from time to time, for the purposes set forth above, as well as for other purposes that may be disclosed later in this Notice.

 

  1. Access, rectification, cancellation, treatment and transfer

 

You have the right to access, rectify, cancel your personal data, as well as to oppose to the treatment and transfer of the same or to revoke the consent that for such purpose you have granted us. Therefore, we inform you of the option you have to exercise any or all of the aforementioned rights:

 

In writing sent to the person in charge of the processing of personal data via email to the address calidad@dysac.com.

 

Likewise, you are hereby informed that DYSAC, as part of its concern for the proper treatment and care of personal information, maintains various mechanisms, procedures and security measures, both administrative, technical and physical, aimed at achieving the protection of such information against damage, loss, alteration, destruction or unauthorized use. It is worth mentioning that as part of such mechanisms and security measures, DYSAC has entered into various confidentiality agreements with its employees, suppliers, service providers and related parties, with which it commits them to carry out an adequate treatment of your Personal Information and to respect the terms contained in this Privacy Notice.

VII. Means to exercise the rights of access, rectification, cancellation or opposition

 

You may exercise your rights of access, rectification, cancellation and/or opposition by contacting the Data Processor directly by e-mail or in writing.

 

Such request must contain and accompany the provisions of Article 29 of the Law, such as:

 

  • Name and email of the Data Subject or other means to communicate the response to your request (preferably email).
  • The documents proving the identity or, if applicable, the legal representation of the Holder.
  • A clear and precise description of the personal data with respect to which the data subject seeks to exercise any of the rights.
  • Any other document or element required by the legislation in force at the time the request is submitted.

 

DYSAC shall not be obliged to cancel the personal data when any of the assumptions established in the Law are involved, among others, the following: that refer to the parties to a private, social or administrative contract and are necessary for its development and compliance; must be treated by legal provision; hinder judicial or administrative proceedings related to tax obligations, the investigation and prosecution of crimes or the updating of administrative sanctions; are necessary to protect the legally protected interests of the Holder, are necessary to perform an action in the public interest or are necessary to comply with an obligation legally acquired by the Holder.

VIII. Transfer of Data

 

DYSAC wishes to inform you through this Privacy Notice that eventually, exclusively in order to comply with the purposes mentioned herein, it may carry out the transfer in whole or in part of your Personal Data to third parties, such as:

 

  1. Companies affiliated or subsidiaries of DYSAC.
  2. Third party service providers for the fulfillment of legal obligations acquired.
  3. Third parties arising from a corporate restructuring, including merger, consolidation, sale, liquidation or transfer of assets.
  4. Other transfers established by law.

We also inform you that the information transferred will be done with the appropriate security measures, in accordance with the principles contained in the Law. If you do not express your opposition to the transfer of your personal data, it will be understood that your consent has been granted.

 

I do not consent to the transfer of my personal data under the terms set forth in this Privacy Notice.

 

  1. Revocation

 

The Holder of the personal data may revoke his/her consent for the processing of personal data at any time, and must, solely for such purposes, send a request by e-mail to the Person in Charge of the Personal Data, mentioned in section VI of this Notice.

 

Likewise, we inform you that we will have a maximum term of 20 twenty working days to inform you about the origin of the same and if it is appropriate, the same will be effective within 15 fifteen working days following the date on which the response is communicated to the e-mail that you provide us for such purposes.

 

  1. Consent of the Holder

 

In terms of the provisions of Article 8 of the Law, it will be understood that the Holder tacitly consents to the processing of his/her personal data, when having made this Privacy Notice available to him/her, he/she does not express his/her opposition.

 

With respect to financial and/or patrimonial data, it will be understood that you have expressly provided such information when you provide it to us verbally, in writing or by electronic means, except for the exceptions set forth in the Law.

 

  1. Changes to the Privacy Notice

 

Finally, DYSAC reserves the right to modify this Privacy Notice, so we inform you that any change or modification to its content will be communicated to you in any of the following ways: visible announcements in our stores; on our website; or it will be sent to the last email address you have provided us.

 

We will not be responsible if you do not receive notification of a change in the Privacy Notice if there is a problem with your email account or data transmission over the Internet.
